Discrimination, Bullying, Harrassment, And Title IX


Bullying means any severe or pervasive physical or verbal act or conduct, including communications made in writing or by means of an electronic act, directed toward one or more students that has or can reasonably be predicted to have the effect of one or more of the following:

  1. Placing a reasonable student in fear of harm to his/her person or property
  2. Causing a reasonable student to experience a substantially detrimental effect on the student's physical or mental health
  3. Causing a reasonable student to experience substantial interference with his/her academic performance
  4. Causing a reasonable student to experience substantial interference with his/her ability to participate in or benefit from the services, activities, or privileges provided to him/her


Title IX remains a critical federal civil rights law which prohibits discrimination on the basis of sex (including sexual harassment) in our schools. It protects male and female students and employees in any educational entity that receives federal funds. In addition, Title IX protects transgender students and students who do not conform to sex stereotypes. State law also prohibits discrimination based on gender (sex), gender expression, gender identity, and sexual orientation.

Statute of Limitations - Uniform complaints alleging discrimination, harassment, intimidation and bullying based on sex (including sexual harassment and sexual violence) must be filed no later than six months from the date the complainant first obtained knowledge of the facts of the alleged harassment.
