Caregiver Affivadit

California law allows a caregiver who is temporarily caring for a student to complete a Caregiver’s Authorization Affidavit to help ensure the student can continue attending school and receive necessary care. Assembly Bill 495 (AB 495), which takes effect January 1, 2026, updates and clarifies existing law related to this affidavit.

The Caregiver’s Authorization Affidavit allows a caregiver to enroll a student in school and make limited educational and medical decisions only when a parent or legal guardian is temporarily unavailable (for example, due to illness, hospitalization, or other short-term circumstances). This affidavit does not transfer custody, override parental rights, or remove a parent’s legal authority. Parents retain full decision-making rights and may revoke the affidavit at any time.
